Witnesses in the assault victim's golf party said that they had just finished playing the ninth hole when they stopped and went into the clubhouse to order some food. Whitaker, his wife and another individual were in a party behind the victim and decided to play through and "cut" the group that was ordering food. The 54-year-old man reportedly became irate about this, saying it wasn't "proper golf etiquette" to cut in front of his group — this is despite his group stopping to order food at the clubhouse and one of his own friends telling him "it wasn't that big of a deal" for the group behind them to play through. But the 54-year-old man confronted the woman in the cutting group anyway, he told police, telling her that she and her group were "a**holes" and even going as far as calling her a "c***." The man then told police the woman went "crying back to her group." Whitaker allegedly demanded that the man apologize for calling his wife a derogatory term, but the older man refused. The two men then "got in each other's faces," according to witnesses, before Whitaker punched the older man in the face. Whitaker is accused of striking the 54-year-old several times before grabbing him around the waist, lifting him up and slamming him onto the ground. Friends of the 54-year-old man claimed he was knocked unconscious by the impact and stopped breathing for roughly 10 seconds. Staff at an Indianapolis hospital confirmed the assault victim suffered multiple broken ribs and a punctured lung. He also had a laceration on his forehead that required several stitches. Whitaker was taken into custody by the Morgan County Sheriff's Department where he was charged with a Level 3 felony. In Indiana, a Level 3 felony carries a prison sentence of up to 16 years in prison.
