EL PASO, Texas (KTSM) - A woman was detained on Monday, March 24, in Anthony, Texas, for having over 2 pounds of crystal methamphetamine within her vehicle, according to documents filed in the U.S. District Court for the Western District of Texas obtained by KTSM.
According to the affidavit, Moni
ca Ivette Lira is facing a possession with the intent to distribute a controlled substance charge, as she had approximately 2.5 pounds of crystal methamphetamine in her possession.
On Monday, March 24, Anthony Police Department officers were conducting routine patrols in the city, which is in the Western District of Texas, when officers observed a parked beige Jeep Cherokee with paper tags matching the appearance of the vehicle that had evaded a traffic stop in February, according to the affidavit.
According to the affidavit, officers conducted a registration check for the Texas paper plate attached to the vehicle, which did not return any record.
Officers then conducted a vehicle check through dispatch, providing the same Texas buyer plate number. Officers were informed that no record was found on the provided Texas plate number, according to the affidavit.
According to the affidavit, officers observed a woman, later identified as Lira, sitting on the front passenger seat of the vehicle with the door open.
Officers made contact with Lira, and they told her that the vehicle matched the description of a vehicle that had previously evaded officers when they attempted to conduct a traffic stop, according to the affidavit.
According to the affidavit, Lira said that her son had taken the vehicle without her permission and the reason for him evading was that he did not have a driver's license and that he and his friends were probably smoking marijuana in the vehicle at the time.
Officers asked Lira if she had any warrants, and she said that she may have warrants but was unsure what they were for. Officers then conducted a warrant check on Lira through dispatch, and officers were told that Lira had a warrant through the El Paso County Sheriff's Office for dangerous drugs, according to the affidavit.
According to the affidavit, officers then told Lira that she had a warrant, and she was detained pending confirmation of the warrant.
Officers asked Lira if there was anything illegal in the vehicle, such as drugs that the officers should be aware of, to which she denied, according to the affidavit.
According to the affidavit, officers smelled the odor of marijuana coming from the vehicle and proceeded to ask Lira if marijuana had been smoked earlier inside the vehicle, to which she said yes, but that it was not she who had smoked.
Officers then conducted a vehicle search and located multiple syringes scattered on the floorboard of the passenger rear seat of the vehicle. Officers also found a clear plastic bag that contained a bundle of clear plastic baggies rolled up using a rubber band in the front passenger seat of the vehicle, according to the affidavit.
According to the affidavit, a pink backpack was also found in the trunk area of the vehicle. A large bundle wrapped in gray material, as well as a second large plastic bag, was found inside the backpack. It contained "a substantial amount of crystalline substance consistent in appearance with crystal methamphetamine."
Officers also found various rounds of ammunition, multiple small clear plastic baggies, a circular scale, and multiple syringes inside the backpack, according to the affidavit.
According to the affidavit, a broken glass pipe was found inside the center console compartment, and multiple clear plastic baggies were found in the passenger glove compartment.
Lira was questioned about the backpack, and she said that it belonged to the driver of the vehicle and that she was aware of its presence inside the vehicle. She also said the driver fled when he saw law enforcement, according to the affidavit.
According to the affidavit, officers asked the DK Gas Station clerk for surveillance footage of Lira's arrival. In the footage, it was confirmed that Lira had arrived at the gas station alone.
Due to heavy pedestrian traffic in the area, the vehicle was taken to the Anthony Police Department for further search. A black firearm was subsequently found underneath the front center console cup holders. It was confirmed that the handgun was stolen through the EPCSO dispatch, with confirmation from the Alamogordo Police Department, according to the affidavit.
According to the affidavit, the handgun was seized and taken to the Anthony Police Department.
Officers also located a buyer's tag receipt for the vehicle listing Lira as the purchaser in February.
According to the affidavit, the suspected drugs found in the vehicle tested positive for methamphetamine with an aggregate weight of 2.5 pounds.
The case was referred to the Drug Enforcement Administration (DEA), as well as Lira's custody and all evidence, according to the affidavit. ...read more read less
