FRESNO, Calif. (KSEE/KGPE) - A man in his 30s has been sentenced to 75 years to life in prison for the murder of a 24-year-old man in Fresno over a football team flag, according to the Fresno County District Attorney's Office. The DA's office announced that 39-year-old Daniel Epimenio Gonzalez of Fresno was sentenced to 75 years to life in prison for the murder of 24-year-old Frank Rojas of Fresno on Thursday, following a weeks-long trial that concluded on Oct. 14, 2024. According to officials, officers with the Fresno Police Department responded to a home on Feb. 1, 2020, regarding a shooting victim. When they arrived, they found Rojas suffering from a gunshot wound to his abdomen. The DA's office says witnesses told officers that while they were in the front yard of the home, beginning to prepare for the Super Bowl the following day, Gonzalez rode by on a bike and began to cuss at Rojas and the witnesses over a San Francisco 49er's flag that was displayed in the front of the house. A verbal argument then ensued, which officials say was carried over to a vacant lot on the north side of the home, where witnesses watched as Gonzalez took a homemade gun out of his backpack and shot Rojas. Gonzalez then fled the scene, but he was located a short time later at a nearby homeless encampment. During a search of the encampment, officers say they found the gun used in the homicide. The DA's office says Gonzalez has a lengthy criminal history dating back to 2002, which includes a prior strike offense from 2013.
