Police said Martinez was sleeping in Fuddruckers at the mall when a security guard told him to leave. New video shows what eye-witnesses told police that day. One man told police security was "rough" with the teen but that the teen was also resisting and didn't want to leave.
"The security guard also threw him on the ground and the kid got up and then the kid started walking around that way and the security guard followed him," said the eye-witness. That's when he said he heard gunfire.
Police said Martinez shot the security guard. They said he took off running from police. The Albuquerque Police Department said he threw his gun underneath a nearby car before surrendering.
Martinez is in custody while awaiting trial. He is facing several charges including aggravated battery with a deadly weapon.
