Former UNM student faces probation violation hearing over Maryland arrest

ALBUQUERQUE, N.M. (KRQE) – One of the former University of New Mexico students sentenced in the ambush of a New Mexico State University basketball player was back in court on Wednesday for a probation violation. Eli-sha Upshaw was sentenced to 4.5 years of probation and allowed to serve that sentence back home in Maryland.
Man who admitted to string of violent robberies in Albuquerque sentenced
Over the summer, he was arrested for assault in Maryland. The state dropped the charges against him because the victim wouldn't cooperate with the police. Upshaw's lawyer asked for his client to be released while the new accusations are sorted out. The state opposed the motion claiming he still violated his probation due to the arrest.
The judge ruled that Upshaw can be released if he qualifies for an ankle monitor. He's due back in court next Wednesday.
