Legislature responds to auditor, AG won't weigh in

BOSTON (WWLP) - After State Auditor Diana DiZoglio's ballot question passed, giving her the authority to examine the finances of the state legislature, lawmakers say they are not yet required to comply.
Shortly after the election, the auditor's office penned a letter to the legislature calling for the records she needed to complete the audit.
On Tuesday afternoon, top lawyers representing the House and the Senate replied to DiZoglio's letter, saying they would not act until the law officially goes into effect. The law will go into effect 30 days after the ballot question results are officially certified, which has not yet happened.
The letter promised a response in due time. "When that process has concluded and thirty days have, the General Court will respond to any audit engagement letter that we receive at that time," said the letter from the legislative branches' lawyers.
They also noted their constitutional concerns--that an audit of the legislative branch by the executive branch could violate the separation of powers clause.
Attorney General Andrea Campbell says she plans to stay on the sidelines of this debate until a legal dispute is resolved. "There's no role for my office to play right now…nothing can happen until the law that just passed goes into effect," Campbell explained during a GBH public radio appearance on Tuesday.
Once the law goes into effect, Campbells says DiZoglio or the Legislature could file a legal dispute, which would position her office to get involved.
For now, voters will have to wait to see how the constitutional questions with this new law play out before seeing a potential full audit of the legislature.
