CANADIAN, Texas (KAMR/KCIT) - Eight years after the disappearance of Canadian teenager Thomas Brown during Thanksgiving week in 2016, his remains have been released from state custody. However, family members including Brown's mother have filed a lawsuit to perform more forensic testing on his remains before burial. The lawsuit was filed in Potter County District Court on Tuesday by Brown's mother Penny Meek, stepfather Chris Meek, and brother Tucker Brown against Brown's father Kelly Brown and a local funeral home. Court documents detail that Brown's mother, stepfather and brother have asked the court for the right to have a hired private investigator video record a forensic examination and DNA test of Brown's remains before they are buried. As noted in previous reports on MyHighPlains.com, 18-year-old Thomas Brown went missing the night before Thanksgiving in 2016. Brown's skeletal remains were found near Lake Marvin in early 2019, about 19 miles east of Canadian, and were taken into investigative custody. The Texas Attorney General's Office released its overview of Brown's case and evidence in 2021, which stated its findings from forensic investigation of his remains did not support a cause or manner of death. Physical evidence also included items belonging to Brown that were found in various places miles away from his car and remains, a .25 caliber casing and trace amounts of his blood found in his car, and a search from the night of his disappearance for a suicide hotline. Further evidence in the AG's report was noted as circumstantial, unexplained, missing or contradictory. The AG suspended Brown's case after finding no viable evidence of foul play in 2019, though it is still considered to be open and awaiting new credible evidence. Brown's mother, stepfather and brother hired Klein Investigations & Consulting, a group led by Phillip Klein, to privately investigate Brown's disappearance and death. Klein's investigative reports have differed from those from the AG's office on multiple points, including timeline details and whether or not to view Brown's death as a suicide or the result of foul play. Case dismissed in Thomas Brown family defamation lawsuit The lawsuit filed by Brown's mother, stepfather and brother on Tuesday has asked the court for permission to have Klein "video and document" a forensic examination of Brown's remains to confirm injuries to his skull and a DNA test to confirm his remains were positively identified. According to the lawsuit, Brown's father has opposed further forensic or DNA testing of Brown's remains. His father's attorney, said court documents, stated that Brown's father opposes Brown's remains being "pilfered" by Klein. Brown's mother, stepfather and brother said in the lawsuit that they would not seek, intend or agree to "pilfering" or "destructive testing" of Brown's remains.
