Neronha files suit against real estate broker for ‘deceptive practices’

PROVIDENCE, R.I. (WLNE) — Attorney General Peter Neronha said that his office filed a lawsuit against a local real estate broker and “associated defendants” for allegedly violating Rhode Island’s Unfair and Deceptive Trade Practices Act.
In the filing the attorney general alleges that Kyle Seyboth and the other defendants “deceived homeowners with limited English proficiency by executing a ‘foreclosure rescue’ scheme,” in which the owners thought they were refinancing their mortgages when were actually executing paperwork for the sale of their home for significantly less than market value.
Seyboth is specifically accused of defrauding Jean Marie and Marie Delva, Haitian immigrants who have lived in Providence for 30 years.
In May 2023, the Delvas fell into default on their mortgage and owed roughly $61,000 to Wells Fargo, while their home was valued at $450,000.
Seyboth and his associates allegedly contacted the Delvas and their daughter Joana Delva about a plan in which Williams and Preferred Property Solutions would add their names to the title, pay off the existing mortgage balance, develop a new mortgage payment plan, and then transfer ownership back.
The Delvas then signed a number of documents they believed was a refinancing agreement, but which actually transferred full ownership to the company.
Neronha also alleged that the defendants did not provide interpretation or translation services as requested.
Seyboth then allegedly listed the home for $450,000, before agreeing with the Attorney General’s Office to take the home off the market and to leave its current occupants undisturbed until an injunction hearing.
Seyboth’s team released the following statement on the allegations:
The Seyboth Team has a well-earned reputation as a top brokerage in Rhode Island and Southern Massachusetts. We deny the allegations in the complaint and remain confident that the facts of the matter will show that the Seyboth Team has acted lawfully. We will put forth a vigorous defense and will not comment further on pending litigation.
