INDIANAPOLIS — An Avon man accused of killing a 16-year-old in 2023 has taken a plea deal. Mouhamadou Diba pleaded guilty to reckless homicide and battery by means of a deadly weapon on Monday. As part of the deal, Diba was sentenced to 1,095 days in jail. Diba, however, was awarded 377 days of actual jail credit and 126 days of earned jail credit. He also had 592 days of his sentence suspended. Additionally, Diba has been ordered to serve 730 days of probation. During that time, all the firearms and ammunition Diba owns will be seized and destroyed. Diba will be allowed to finish his schooling while he is on probation, though he will not be allowed to attend schools within Marion County or the Avon School District. A landline will also be installed at Diba's residence so probation officers can call him periodically to ensure he is complying with the rules of the deal he accepted. Diba will only be permitted to leave home 30 minutes before school starts. He must also be back home within 30 minutes of school letting out for the day. Diba was accused of killing 16-year-old Chrisitan Peters in October 2023. At that time, Indianapolis Metropolitan Police Department officers found Peters lying in the street near the intersection of Scotland Drive and Bank Lane. Peters died after being rushed to the hospital, and Diba, who was 18 at the time, later called police and admitted that he was involved in the shooting. Diba was preliminarily charged with murder. At some point in the case, the preliminary murder charge was thrown out. Previous reporting indicates a second juvenile was also injured in the shooting. He was transported to a local hospital in stable condition.
