MEMPHIS, Tenn. -- One of the former Memphis Police officers recently convicted in the Tyre Nichols federal trial has filed an appeal regarding the judge's decision to keep him behind bars until his sentencing. On Monday, Tadarrius Bean and Justin Smith were released on bail. Demetrius Haley, who was denied bail because he was convicted of more crimes than the other ex-officers, is now fighting for his release with the help of his attorneys. Verdicts announced in Tyre Nichols federal trial; ex-officers taken into custody A motion was filed on Thursday, with his attorneys arguing that Haley should be granted bail while he awaits his sentencing on January 22. According to the court document, Haley's attorneys, Michael Stengel and Stephen Leffler claim the Magistrate Judge who decided to deny him bail considered Haley's convictions to be of violent crimes, but Stengel and Leffler disagree. Haley was convicted of the lesser crimes of violating Nichols' civil rights resulting in bodily injury, not death. It is unclear when the motion will be heard, but the statute says “It shall be determined promptly." The District Judge could either order a hearing or rule without a hearing.
