Investigators have identified the sheriff’s detective and gunman who exchanged gunfire Friday at a National City car dealership, where the suspect was killed and the deputy was injured by shattered glass. Detective Douglas Akers shot Gene Stewart, 46, of Lakeside, after Stewart allegedly fired at least one shot at the undercover detective in a Dodge dealership lot, San Diego homicide Lt. Lou Maggi said in a news release Wednesday. Akers has been with the sheriff’s office for approximately 35 years. He is assigned to the East County Regional Gang Task Force. The San Diego Police Department is handling the investigation under a countywide protocol designed to prevent departments from investigating shootings by their own officers or deputies. The shooting occurred shortly after uniformed deputies pulled over an Acura sedan on Mile of Cars Way near Hoover Avenue around 1:20 p.m., Maggi said. During the stop, a man in the front passenger seat, later identified as Stewart, exited the car and ran from deputies. The driver — a 29-year-old man — and a passenger in the backseat — a 36-year-old woman – were quickly arrested on suspicion of drug-related charges and felons in possession of body armor. Deputies asked National City police for help in finding the man who ran. During their search, a witness flagged down Akers, who was helping look for Stewart, Maggi said. The witness reported seeing a man run through the car dealership lot and get into a tow truck parked on the property. A National City motorcycle officer joined Akers as the detective searched for Stewart. They eventually spotted him inside the truck and approached him. As Akers gave commands, Stewart allegedly fired at the detective, Maggi said. At least one bullet exploded the passenger side window of the tow truck, and flying glass shards caused minor injuries to the detective. Akers returned fire and struck Stewart, Maggi said. Stewart died at the scene. Investigators said they found a firearm that jammed near Stewart, Maggi said. When the Police Department completes its investigation, it will be reviewed by the county district attorney’s office to determine if Akers bears any criminal liability. The sheriff’s office will conduct an administrative investigation into the detective’s discharge of his firearm. The Citizens’ Law Enforcement Review Board will conduct a review of the incident and provide any recommendations. The FBI and the U.S. Attorney’s Office will also monitor the investigations.
