ALBUQUERQUE, N.M. (KRQE) – An Albuquerque man who shot at a car last year at Adam Food Market will not be spending any time behind bars. In January 2023, Mohammad Khala, who was the manager of the store, told police a man pointed a gun at him. Khala said he fired toward the man's car to protect his wife who was also in the store. Albuquerque city employee accused of aggravated battery He was convicted in April of this year. The state asked for a sentence of 8.5 years but Judge Joseph Montaño disagreed. "The fact that you haven't had any criminal instances before this, given your age, I'm not going to incarcerate you. However, I'm not going to authorize a conditional discharge. The fact that you discharged a firearm in this setting and situation that you did, is unjustifiable," said Judge Montaño. Khala was given 5 years of supervised probation.
