WASHINGTON (NEXSTAR) – TikTok, one of the most popular social media apps, may be banned in the United States. The company's lawyers were fighting in federal court to stop a possible ban.The app must find new owners or get off the app store by January 19th unless lawyers can convince an appeals court to let them stay. “There's no question that the clock has been TikTok-ing pretty quickly on this,” said lawyer Seth Berenzweig.TikTok is one of the most popular social media apps for young people, 170 million Americans use it.  Even the presidential candidates are trying to connect with young voters on the app. Earlier this year Congress overwhelmingly passed a bill to ban the app, concerned about national security because of TikTok’s Chinese owners.  President Joe Biden signed it in April.Congress had two main issues with the app: the control China had over the content Americans see and the amount of data TikTok collects on American users. “This app is a Chinese spy balloon in Americans' phones,” said Rep. Michael McCaul (R-Texas.).TikTok’s lawyers argued the law violates free speech, but judges were skeptical the First Amendment applies to companies outside of the U.S. “This case is different because it involves something happening abroad,” said Judge Srinivasan. Lawyer Seth Berenzweig predicts the government will win in court.“I don't think it's a very strong case, quite frankly, because I don't think that TikTok has a constitutional First Amendment freedom of speech right,” said Berenzweig.The court expects to rule in early December.
