SAN FRANCISCO (KRON) -- A San Francisco nanny who was hit by a pickup truck while walking with a 2-year-old in a stroller has filed a lawsuit against the driver and the company he was working for at the time of the crash. The incident happened April 16 in the Marina District near Moscone Park. Mil y Flores was walking across Chestnut Street at Laguna Street with the child when she was hit by a pickup truck, according to the lawsuit. The stroller was destroyed, but the child was not injured. Flores was thrown several feet in the crash and continues to recover from her injuries. "She has some pretty significant orthopedic injuries involving her left ankle, her left knee and her left hip, and also sustained a mild traumatic brain injury," Flores' attorney, Loren Schwartz, said. Schwartz said Flores is optimistic and recently was able to return to work. She will still need continued treatment and physical therapy, he said. The lawsuit alleges the driver, Fernando Gonzalez, made an unsafe turn into the crosswalk. Schwartz said the case is based in part on witness statements, police information and surveillance footage that captured the aftermath of the crash. "Some of it is from witnesses, some of it is from police, there was some surveillance footage that captured not the accident itself, but the aftermath of it," Schwartz said. California law requires drivers to yield the right of way to pedestrians crossing in a marked or unmarked crosswalk. The lawsuit names Gonzalez and his company, Rada Homes LLC, as defendants. KRON4 attempted to reach Rada Homes but did not hear back in time for this report. Schwartz said they are still attempting to serve the lawsuit. Once served, the defendants will have 30 days to file a formal response in court. The lawsuit also seeks to make the intersection safer for pedestrians. "Sometimes even if an intersection is designed as safely as possible, sometimes it is just the fault of the motorist. And in this case we believe the motorist made an unsafe left turn," Schwartz said. Schwartz said the intersection could also be improved with additional safety measures, such as flashing lights or a raised crosswalk. ...read more read less
