(KRON) -- Prosecutors charged two men with hate crimes for attacking a San Jose State University student on campus while the duo yelled anti-gay slurs, the Santa Clara County District Attorney’s Office said. Josue Medina Flores, 19, of Sunnyvale, and Christian Gabriel Nunez Petty, 20, of Fremont, will be arraigned Wednesday at the Hall of Justice in San Jose to face felony charges. SCCDAO said the attack was unprovoked. Flores and Petty are accused of brutally punching and kicking the student, as well as his female friend who tried to help him. The incident happened at 3:44 a.m. on Saturday, September 19, when the victim and two female friends walked past Flores and Petty on SJSU's downtown campus. The two men asked the student if he was gay and yelled anti-gay slurs, prosecutors said. The student and his friends ignored them and tried to continue walking. "The two men then ran up to the victim and attacked him, punching him in the head more than two dozen times and kicking him. All the while, they used homophobic slurs," SCCDAO wrote. When one of the student’s friends jumped on top of the victim to shield him from the blows, Flores and Petty attacked her too, according to prosecutors. The victim was treated at a hospital for his injuries and released. Prosecutors said the attack was captured on the university's security cameras. The DA’s Office has filed 14 hate crime cases in 2026. "If you hurt someone because of their race, religion, gender, or sexuality, you will be arrested and prosecuted," District Attorney Jeff Rosen said. "Tolerance and diversity are cherished values in this community.
