(KRON) -- California Attorney General Rob Bonta and the County of Santa Clara further blocked the construction of an Immigration and Customs Enforcement (ICE) facility on a 24.5-acre parcel in unincorporated Santa Clara County near Gilroy, county officials announced Saturday. “We’re hopeful the court’s ruling sends a clear message that this is the wrong process and the wrong place for this facility,” Santa Clara County Counsel Tony LoPresti said in a statement. The Government Services Administration -- responsible for acquiring property for the federal government -- leased the land from a private developer to use as a "likely Enforcement and Removal Operations (ERO) holding facility." "From there, the federal government moved to build out the site rapidly and without transparency," county officials said in a statement. Bonta and LoPresti filed a lawsuit challenging the construction in June calling it "illegal." The complaint alleges the developers of the ICE facility have not allowed county investigators to inspect the property during construction and that further use will cause "irreparable harm" to the surrounding community. "Based on known hazardous waste violations at the Holsclaw Property, and the agriculturalresearch companies’ failure to complete site closure requirements, the County’s Public HealthDepartment has concluded that “the contamination of structures, soils, the septic system, andgroundwater at the Holsclaw Property is likely if construction continues before the hazards areassessed and/or addressed,” the complaint states. Lee of the U.S. District Court granted a preliminary injunction to further push construction and require the federal government to submit a proposed order by Sept. 30 outlining the ruling or relief they want the court to adopt.
