On Wednesday, the Monterey County District Attorney’s Office released a statement clarifying some details of the investigation into the dead infant found on the side of the road in August. On Monday, the Monterey County Sheriff’s Office said one of the suspects involved in the case was the in fant’s 14-year-old mother; on Wednesday, however, the DA’s Office said it has “not received a filing request for criminal charges” against the minor. The DA’s Office explained that law enforcement obtained a Ramey warrant, which is issued by a judge based upon finding of probable cause. It added that, ultimately, the DA’s Office is responsible for determining whether charges will be filed. The DA’s Office said it , “recognizes the 14-year-old is a victim of her father’s abuse.” For that reason, if the teen is found, the DA’s Office said it’s District Attorney victim advocates and partner agencies will be ready to assist her, connect her with resources and ensure she receives the help she needs. “Whether she is currently able to seek assistance or not, we want her to know that help is available and that our office and our community partners are prepared to support her when she is able to access those services,” the DA’s Office wrote. On Aug. 1, at around 8:30 a.m., a newborn girl was found on the side of the road in the 100 block of Struve Road, authorities said. The sheriff’s office said the newborn was declared dead at the scene, and a postmortem forensic exam allegedly found that she had signs of traumatic injury. The DA’s Office said criminal charges were filed against the teen’s biological father, Sergio Galvez Perez, on suspicion of sexually assaulting the 14-year-old. Additionally, authorities said they are reviewing potential charges involving the teen’s mother, but noted these potential charges are unrelated to the death of the infant and unrelated to the sexual assault allegedly committed by Perez. ...read more read less
