A surrogate mother asked a Dallas County court to order medical care for the baby she’s carrying. The State of Texas just stepped into a multi-state battle over who will be the parents of a baby. This is a developing story, and NBC DFW hopes to learn more in the days ahead. According to cou rt documents, a couple in California, Nausheen Gilkar and Omar Ahmed, went to surrogate McKenna West to have a child for them. Her due date is in early September. In the last few months, according to a court brief, the couple and the surrogate got into a dispute over what to do after the baby was diagnosed with a rare heart condition that required three surgeries after birth and would impact him for the rest of his life. According to the surrogate, she was concerned the biological parents wanted to abort the fetus or not provide life-saving care after birth to let the child die. NBC DFW has reached out to the attorneys of the biological parents to hear their side of the story and has not yet heard back. Meanwhile, Attorney General Ken Paxton’s office sent a letter to UT Southwestern Medical Center and Children’s Medical Center of Dallas. The state also filed a brief in Dallas County court to do two big things: first to provide life-saving care after the child is born; second to keep the child in Texas and to not send the child to the biological parents in California. NBC DFW has not yet heard back from the two hospital systems. This appears to be a complicated case. There’s an ongoing court case in California to decide who the parents are, the biological parents in California or the surrogate mother from Alaska who’s now in North Texas. Texas law does not recognize the Alaska surrogacy contract between the couple and the surrogate because it’s not a “sister-state.” A court hearing has been set in Dallas County on August 25th. ...read more read less
