After two bullets struck the exterior of a new Northwest ISD middle school campus, the district is taking a nearby gun range to court after its owner admitted a “goober” could shoot over a protective berm toward the school. NBC 5 obtained a copy of the court filing (embedded below), which sai d two bullets hit the Barksdale Middle School campus in separate incidents in May and July. The first bullet was found lodged in a wall on May 26. Last week, a second bullet struck a glass wall at the school’s stadium press box. Based on where the bullets were found, the district said it believes they came from people shooting in the direction of the school from inside Quail Creek Gun Range, located about a mile away to the south. The district said it filed a police report after the first incident. After the second, district officials followed up with Northlake Police, who then visited the gun range. “There is a berm on the gun range intended to stop bullets, but it appears patrons can fire over the berm and strike the school. In addition to the current property damage, NISD staff are concerned that students, parents, staff and/or visitors may be struck by stray bullets when they are on campus,” the district said in the filing. The district also met with the gun range’s owner, identified in the lawsuit as David Rose. According to the filing, Rose told district officials it was possible for a “goober” to “intentionally or inadvertently” elevate a firearm and shoot over the berm. The filing also said Rose acknowledged that “more safety features could prevent bullets from being fired over the berm, but that the gun range has not taken such measures.” According to the filing, the district is seeking a temporary restraining order to prevent the range from operating in a way that negligently allows bullets fired from the property to damage school property or endanger students, parents, staff, and visitors. Barksdale Middle School’s principal also detailed the incidents in a letter to parents and outlined steps the district is taking to protect people on the new campus. The principal said the lawsuit seeks safety improvements at the gun range and emphasized that the district is not asking for it to close. Instead, school leaders are seeking what they described as reasonable safety measures. Student camps scheduled for this week will now begin after the gun range closes, the letter said. NBC 5 reached out to Quail Creek Gun Range but had not heard back. Barksdale Middle School is scheduled to open Wednesday, Aug. 12.
