HANCOCK COUNTY, Ind. A driver who fired fatal shots following a road rage incident last week will not face criminal charges, the Hancock County Prosecutor's Office announced.According to the prosecutor's office, the incident oc curred around 3:30 p.m. on July 21 as a Volkswagen Jetta, with a male driver and female passenger, was traveling from Marion County into Hancock County.A Dodge Journey followed closely behind, at times less than a foot away, witnesses said.When both vehicles came to a stop in a construction zone in western Hancock County, prosecutors said the Dodge driver exited his vehicle and aggressively confronted the Volkswagen's occupants, threatening bodily harm.He briefly turned back toward his own vehicle before returning toward the Volkswagen.The prosecutors office said the Volkswagen driver stepped out armed with a handgun and warned the approaching man: I wouldn't do that. Don't do that. Go back to your car.The Dodge driver continued advancing and was shot multiple times. He retreated to his vehicle, where he later died.During the investigation, a witness described the Dodge driver as very hostile and said he heard him say,Oh, you gonna get your gun? You afraid? You gonna get your gun? Well, come on, get out.The witness also told police, If I was put in that predicament, if I was the guy in the Volkswagen, I would have been scared for my life."The evidence in this case establishes that the Dodge driver followed the Volkswagen at an extraordinarily close distance; exited his vehicle and initiated the confrontation; aggressively approached the occupied Volkswagen; threatened bodily harm; challenged the Volkswagen driver to retrieve a firearm and exit the vehicle; briefly turned toward his own vehicle; and then renewed his approach despite repeated verbal warnings to stop and return to his vehicle," The Hancock County Prosecutor Office said in a statement.After reviewing witness statements, video recordings, and forensic evidence, the Hancock County Prosecutor's Office determined the Volkswagen driver acted within Indiana's self-defense law and will not face charges. ...read more read less
