A Nampa father, charged in connection to the death of his 12-day-old could spend 15 years in prison.Judge Thomas Whitney handed down the sentence after about two hours of testimony from State prosecutors, defense attorneys, and two Nampa detectives. Six years of that sentence are fixed, and nine years will be indeterminate.Judge Whitney considered Lemke a danger to "the good order of society" for his decision making in failing to report the death of 12-day-old Benjamin, alteration of evidence, and determined the counts too serious for probation. In December, 12-day-old Benji was found dead, after a 911 call reporting an unresponsive infant. Under the agreement, two additional charges of felony injury to a child, and resisting or obstructing an officer were dismissed.Benji's death inspired "Benji's Law" signed by Gov. Brad Little earlier this year.
