Laramie County Sheriff Brian Kozak must appear in court to explain why a law firm seeking information related to a deportation case shouldn’t be allowed to inspect certain records it requested, a judge ordered Monday.  Judge Robin S. Cooley set a hearing for 10 a.m. Thursday in Laramie County District Court in Cheyenne.  The hearing comes after Denver-based law firm Lichter Immigration and Laramie County resident Kevin Lewis, whom the firm retained as an investigator, filed a complaint accusing the sheriff’s office of blocking access to evidence last month. The law firm and Lewis sought access to digital evidence after receiving what they say was a false report about the arrest of long-time Laramie County resident Mario Fabian Valenzuela Robles, a Mexican citizen with three children. He was arrested after being stopped by a sheriff’s deputy. Lichter Immigration and Lewis eventually obtained a corrected version of the written report, but they continue to seek video footage of Valenzuela Robles’ arrest. These records, they said, are crucial to Valenzuela Robles’ ongoing immigration case. The plaintiffs are represented by Cheyenne attorney Drake Hill, a former Wyoming GOP chairman and the spouse of former Wyoming Superintendent of Public Instruction Cindy Hill. Lewis was a staffer in Cindy Hill’s office when she was state superintendent. Kozak responded to the plaintiffs’ allegations in a social media video, stating that discrepancies between the two versions of the arrest report resulted from a copy-and-paste error. He also said that his office hadn’t turned over footage of the arrest because the plaintiffs didn’t adequately prove they made the records request on Valenzuela Robles’ behalf.  The law firm disputed Kozak’s explanation that the report errors came about from “a single cut a paste error.” The plaintiffs claim that after Lewis provided the sheriff’s office and county attorney with a retainer letter, neither Lewis nor the law firm were asked to provide further proof they represented Valenzuela Robles.
