California Attorney General Rob Bonta announced Monday that the state has filed a lawsuit against the Trump administration over its decision to reclassify four Clean Air Act preemption waivers. The waivers include the 2008 greenhouse gas emission standards waiver, the Advanced Clean Cars I (ACC I ) waiver, the 2022 reinstatement of portions of the ACC I waiver and the 2022 Small Off-Road Engine rule amendment. The waivers allow California to implement emissions standards that are stricter than federal requirements. The Environmental Protection Agency originally granted the waivers as “orders.” The agency is now reclassifying those orders as “rules.” State officials argue the change carries significant consequences. “This may sound very technical, and it is, but it’s also a critical distinction. Orders aren’t subject to expedited congressional disapproval,” Bonta said. “Rules, however, are subject to expedited congressional disapproval.” Bonta argues the EPA lacks the legal authority to reclassify the waivers and is exceeding its authority in what he described as an effort to undermine California’s clean-air policies and environmental progress. ...read more read less
