Acy, who was responding to another crash during snowy conditions on Interstate 80 involving a snow plow.
Now, the Cass County Attorney will have to decide to retry the case against the defendant, Thomas Jordan, according to Nebraska law.
McAcy was a 10-year veteran of the State Patrol. A preliminary investigation determined Trooper McAcy and another trooper responded around 9:20 a.m. on Feb. 17, 2025 to a crash involving a Nebraska Department of Transportation snowplow and two passenger vehicles on eastbound I-80 near Ashland.
NSP said one of the vehicles hit the rear of the snow plow as it was plowing the interstate.
The troopers checked on everyone involved in the crash and noticed one driver suffering from neck pain. While the other trooper provided first aid to the driver whose vehicle came to a rest in a ditch, Trooper McAcy spoke with Jordan, who was outside of the snow plow.
The Cass County attorney confirmed Jordan was the driver of the snow plow.
