Florida Man Facing Assault Charges in Lincoln Waives Extradition to Iowa for Murder Case

LINCOLN–(KFOR May 2)–The man accused of attacking a Lincoln Police officer Tuesday night inside a bathroom at Arby’s off of 27th and Nebraska Parkway, is now
accused of assaulting a staff member at the Lancaster County Jail on Thursday and on Friday, waived his right to extradition to Pottawattamie County, Iowa related to a Tuesday homicide at a Carter Lake hotel.
The suspect, 36-year-old Joseph Bertolino of Jacksonville, Florida, is accused of being involved in the death of 62-year-old Kenneth Gauff, of Omaha. Gauff’s manner of death was ruled as a homicide.
Via hotel surveillance video, investigators saw Gauff entering the room by himself at 5:19 p.m. Tuesday, then Bertolino is seen entering the room at 5:46 p.m. then leaving at 6:28 p.m. by himself with blood on his shoes.
When Bertolino was in jail in Lancaster County, police said he made comments regarding the scene inside the hotel room. The Lincoln Police Department recovered his bloody clothes and a suspected murder weapon, according to the report. That followed an incident inside the Arby’s off of 27th and Nebraska Parkway on Tuesday night, where Bertolino apparently had been arguing with a woman. After an officer arrived and found him in a bathroom, a struggle ensued between the officer and Bertolino, where a gunshot was fired from the officer’s service weapon. However, it’s not clear who had their hand on the gun. Vollmer says a taser was then used on Bertolino.
The gunshot hit the floor and bullet fragments injured the officer, who was then treated at the hospital. Bertolino was checked out at a hospital and later arrested for attempted first-degree assault on an officer.
Then shortly before 11am Thursday, Bertolino was involved in an assault on a corrections officer at the Lancaster County Jail. LPD Sgt. Chris Vollmer on Friday said officers got the call to the jail, where a staff member was assaulted in the infirmary while Bertolino was being taken back to his cell. Vollmer says Bertolino wasn’t cooperating and a struggle happened.
During the incident, Vollmer says the corrections officer was hit by what he called a conducted energy device, suffering minor injuries.
