RICHMOND, Va. (WRIC) -- Certification of Virginia’s redistricting referendum is on hold. On Friday, May 1, the State Board of Elections planned to certify the results, allowing Virginia’s new congressional map to go into effect, but due to a court order, they passed by that part of their agenda . Earlier this week, a spokesperson for the Department of Elections said certification was planned for Friday, but added, “Whether certification occurs on this date or after is contingent upon when a final ruling is made by the Virginia Supreme Court and what that ruling states.” Currently, several cases are moving through the legal process.  On Monday, the Supreme Court of Virginia heard an appeal from Democratic General Assembly leadership, the state and others after a Tazewell judge found Democrats didn’t follow the proper procedures to get the redistricting amendment to voters.  That same judge ruled in another case that the State Board of Elections can’t certify the results of the referendum because the referendum was invalid or illegal for several reasons.  Attorney General Jay Jones is appealing that ruling, but on Tuesday, the Supreme Court denied his request to allow the Board of Elections to certify the results while that appeal plays out.  That means for now, without certification, Virginia’s new congressional map that includes ten seats that favor Democrats and one that favors a Republican, can’t go into effect.  “If an order from the Supreme Court permits certification, we will convene a meeting of the board as soon as feasible for that purpose,” said Department of Elections Commissioner Steven Koski.  It’s unclear when exactly the Virginia Supreme Court will ultimately make its decision.  ...read more read less
