HENRICO COUNTY, Va. (WRIC) -- The cases against two former Richmond Montessori School employees were dismissed in court Monday after a toddler wandered into traffic while in their care in 2024. Thirty-four-year-old Abigail Baracat and 31-year-old Rebeca Rosas-Eterovic were each charged with one misdemeanor count of delinquency of a minor in May of 2025. The toddler walked onto Parham Road on Nov. 22, 2024.   The cases being dismissed in Henrico County Juvenile and Domestic Relations Court on Monday, April 20, was expected. The last time the women were in court was in October of 2025, and the judge said the cases would be dismissed should they maintain good behavior. Judge Marissa Mitchell found the women have maintained good behavior since then, and the court upheld its promise to dismiss the charges. The Richmond Montessori School is a child daycare school for children ages 18 months to 13 years old. It's located at 499 North Parham Road. When the two-year-old boy wandered off, he was fortunately saved by a good Samaritan. 8News previously reported that Baracat and Rosas-Eterovic were on a walk with seven children from the school around 9:30 a.m. when the boy wandered off. Neither of the women noticed. The Department of Social Services inspected the school in December of 2024 following the incident and found the school in violation of four state policies, including the standard of care and protection, and not notifying the boy’s parents immediately.   A spokesperson for the school said neither Baracat or Rosas-Eterovic reported what happened immediately, and the boy's parents were notified more than 24 hours later after the school learned about it.    Rosas-Eterovic's attorney, Lee Kilduff, said they were pleased with the outcome. Baracat’s attorney, Russ Stone, agreed and said the charge has weighed on her. “Everybody agreed what happened was tragic," Stone said. "It was a mistake that shouldn’t have happened. But that doesn’t mean a person has to be labeled a criminal and as a result of what happened today, they won’t be...It’s always stressful when you have to deal with a criminal charge. I mean, for any defendant.”   Baracat and Rosas-Eterovic will each pay $91 in court fees.   A spokesperson for the school shared a statement with 8News saying they've put a permanent fence around the school and that a Safety and Security Committee meets monthly. “Richmond Montessori School (RMS) continues to be deeply saddened by the incident that occurred on Parham Road in November 2024 and the impact it has had on the individuals in our community. RMS remains grateful for the positive outcome of the student involved. In the nearly 18 months following this near tragedy, our school has committed to learning everything possible from the incident, including updating our safety protocols and risk management systems. We have engaged in an external safety audit, installed a permanent fence around our campus, and commenced a Safety Security Committee that meets monthly. We are committed to continuous improvement in all aspects of school safety. As we move forward together, our focus is steadfast: to ensure the well-being of every student, staff member, and family, and to take every measure possible to prevent such an incident from ever happening again.”  ...read more read less
