Napa sheriff arrests man suspected of creating AI child porn

(KRON) -- An American Canyon man who allegedly used artificial intelligence to create child pornography was arrested this week by the Napa County Sheriff’s Office.
The investigation into 46-year-old Brian Nathan Guthrie began in March after the sheriff’s office received a tip from the Internet
Crimes Against Children (ICAC) task force. The tip “indicated a person from the city American Canyon was creating AI generated Child Sexual Abuse Material (CSAM),” authorities wrote.
California signed AB 1831 into law in 2024, which amended relevant child pornography penal codes to include computer-generated imagery. “The creation of CSAM using AI is inherently harmful to children because the machine-learning models utilized by AI have been trained on datasets containing thousands of depictions of known CSAM victims, revictimizing these real children by using their likeness to generate AI CSAM images into perpetuity,” the legislation states.

Detectives identified Guthrie as the suspect and detained him on Tuesday. Investigators then searched his residence in the 200 block of Hummingbird Way to collect evidence.
Guthrie was arrested and booked into the Napa County Department of Corrections for charges of possession of child pornography and manufacturing child pornography. He remains in jail as of Thursday morning. Bail was set at $50,000.
