(Courtesy of Fairness for Girls)LINCOLN–(KFOR Mar. 9)–The conservative-leaning organization, Fairness for Girls, announced Monday in a news release that a signature-gathering effort is getting underway to have Nebraska voters decide to limit sports participating in grades kindergarten through 12 th grade and college to whether a team is male, female or mixed. The objective for Fairness for Girls is to get a measure on the November general election ballot, which would amend the Nebraska Constitution “to establish constitutional protections for sex-separate athletics to ensure equal access to athletic opportunities for females.”  The ballot initiative also includes the following: For purposes of this section, “schools” shall mean interscholastic, intercollegiate, and intramural athletic teams or sports that are sponsored by a common school of this state, a public postsecondary educational institution of this state, or any school or institution of learning in this state not owned or exclusively controlled by the state or a political subdivision thereof whose athletic teams or sports compete against a common school or public postsecondary educational institution of this state, or any school or institution of learning in this state not owned or exclusively controlled by the state or a political subdivision thereof whose athletic teams or sports compete against a common school or public postsecondary education institution of this state. This section shall be self-executing, but legislation may be enacted to facilitate its operation. If any part or parts of this section are found to conflict with federal law or the Constitution of the United States, this section shall be implemented to the maximum extent permitted by federal law and the Constitution of the United States. Any provision held invalid shall be severable from the remaining portions of this section. If passed, the amendment would put in a state law requiring that all student-athletes competing in public K-12 or college sports this fall must do so on the team that matches their sex at birth. Several other states have pursued similar laws. The U.S. Supreme Court is hearing a case to decide whether 27 states’ laws that bar transgender girls from participating in team sports at publicly funded schools would be unconstitutional.  The group would need to gather the signatures of 10% of the state’s registered voters by July, in addition to gathering signatures from a geographic cross-section of Nebraska to change the state constitution. ...read more read less
