Emotional and at times shocking testimony unfolded in court Friday as parents described what they experienced at a San Jose home daycare where two toddlers drowned in a backyard pool in October 2023. Four parents took the stand during the second day of testimony in the trial of Shahin Gheblehshen as, who faces three child endangerment charges connected to the deaths at Happy Happy Daycare. On Friday, Gehblehshenas sat quietly in court as parents testified, listening through a Farsi translator. A mother told jurors she believes the only reason her son avoided the pool that day was because she dropped him off late after a doctor’s appointment. When she learned her son’s best friend had fallen into the pool, she said she knew without a doubt her son would have bee with him that morning. She was also emotional telling jurors she almost rescheduled his appointment. Through testimony it was also conveyed that another mother arrived to drop off her child that morning after one toddler had already been pulled from the pool and paramedics were on their way— but she said no one warned her about the emergency unfolding inside the home. She said co-owner Nina Fathizadeh opened the door looking tired and took her son inside but never told there was an emergency. The same parent also testified that prior to the incident she noticed a side gate to the property that led to the backyard had been left open and said about a month before the drowning incident, her son required eight stitches on his forehead after a fall while at the daycare. She said Gehblehshenas called her saying she need to take her son to the hospital. The mother of a two-year-old boy who survived the incident told jurors her son has physically recovered after falling into the pool, but said he cried at night and became fearful during bath time following the pool incident. A fourth parent testified his twin children were temporarily moved from the licensed daycare to another unlicensed home daycare at 1111 Pippin Creek Court, a home Fathizadeh allegedly rented. He said he was told by Fathizadeh the move was temporary due to construction. He also said there were at least four other children enrolled at that location, and he noticed the same three caregivers working at both daycares. Parents also told jurors they had limited access inside the daycare home. Most said drop-offs happened at the door, and they rarely entered the house.
