Child predator released from California prison, immediately rearrested

(KRON) -- Serial child predator David Allen Funston was granted parole and he was released from a California prison on Thursday. But he didn't get very far before deputies swooped in, re-arrested him, and locked Funston in jail.

d they handed him over to sheriff's deputies in Placer County, where he was arrested in connection to a newly-filed child molestation case.
Inmate records show Funston, 64, was booked into a Placer County jail Thursday for lewd or lascivious acts against a child. He remained in custody without bail as of Friday afternoon.
Earlier this month, news that Funston was slated to be freed from prison under California's elder parole system triggered outrage.
In 1999, he was sentenced to life with the possibility of parole for kidnapping children and sexually abusing victims as young as 4 years old.
Last week, Sacramento County Sheriff Jim Cooper described Funston as a "serial child molester who used candy and toys to lure children seven years old and younger."
He was found eligible for parole at his first hearing before the Board of Parole Hearings on Sept. 24, 2025. On Feb. 18, 2026, the board reaffirmed its decision to release Funston under the state's Elderly Parole Program.
In response to the board's decision, Cooper wrote, "How do they explain that to those children and their parents? How do they tell families that a predator of this nature is 'no longer a risk?' Under California’s Elderly Parole Program, inmates over 50 are eligible for parole. He is 64. Age does not erase predatory behavior. It does not undo grooming. It does not restore stolen childhoods. Childhood sexual predators do not suddenly become safe because they turned 50."
With new charges filed, Funston is scheduled to appear in a Placer County courtroom on March 2 for an arraignment.
The Placer County District Attorney’s Office said the new charges stem from the sexual assault of a young child in Roseville in 1996.
The DA's office explained, "At the time of the original investigation and prosecution, the defendant was convicted in Sacramento County and sentenced to three life terms in prison for his crimes. These life sentences ensured the defendant would be removed from society. However, due to recent developments under California’s elder parole program, the defendant has been released from CDCR, effectively overturning the permanence of the prior life sentences."
Prosecutors said they refiled the 1996 charges this week in the interest of public safety.
"To be clear, this individual was previously sentenced to multiple life terms for extremely heinous crimes," said Placer County District Attorney Morgan Gire.
