Families file lawsuit against daycare for injuries to children

Five families filed a lawsuit against a North Texas childcare provider, alleging injuries and mistreatment at the hands of caregivers. They said they reviewed footage of their children being yanked, dropped, and yelled at.
The facility is no longer occupied, and parking spaces are now empty. What
remains is an impression on a sign that once said, ‘Camden Hill Montessori.’
It started with a call from Jamus Hernandez’s wife.
“She said, ‘hey daycare called me, our son is hurt. I’m going to go pick him up,’” said Hernandez.
He said they took their son to the ER, and then to a specialist for his injury.
“What we found out is it was essentially kind of deep bone bruising,” he said.
He recalls the moment everything clicked.
“When the doctors started asking us questions that kind of seemed like we were the reason why this was potentially the reason why this happened to our child, and that kind of raised a red flag to us like maybe there’s something going on deeper,” Hernandez said.
Hernandez and his wife pressed the daycare for camera footage of their one-year-old child, which they were eventually allowed to see.
“She just yanks him up by his arm, and then just carries him all the way across the room ad then just drops him,” he said.
They filed a report, and it set off a chain of events. Since then, other families have come forward.
In documents obtained by NBC 5, a lawsuit filed on behalf of five families alleges serious physical, emotional, mental and psychological injuries.
It said what started as an investigation into the injury of one toddler unraveled into an exposure of systemic failure, revealing more than 140 separate instances.
Hannah Showalter, another plaintiff in the case, remembers seeing her child on a recording as well.
“We were just distraught,” she said. “Just so much screaming and pulling and grabbing that no child should ever have to go through.”
In an arrest warrant related to the case, 28-year-old Melissa Rodrguez charged with injuring a child.
Russell Button represents the families. He tells us they want answers about the policy and procedures put in place by the facility and claims in the lawsuit that Camden Hill failed to properly train, hire and supervise employees.
“You don’t do this one time and be done with it,” said Button. “This had to have been going on for a long period of time and people should’ve stopped it along the way.”
NBC 5 made contact over the phone with a woman claiming to be the former director of the daycare. She directed us to the owner. We placed a call, and we are awaiting a call back.
Meanwhile, the parents say they want to speak for the children who couldn’t speak for themselves.
“The truth of what happened needs to be talked about,” said Showalter.
