Charges dropped against 2 Warwick men in deadly Gillette Stadium fight

FOXBORO, Mass. (WPRI) — Charges have been dropped against two Warwick men in connection with the death of a fan at a New England Patriots game in 2023.
Justin Mitchell and John Vieira were charged with assault and battery and disorderly conduct. Last week, those charges, originally filed in Wre
ntham District Court, were dropped.
On Sept. 17, 2023, first responders rushed to the 300 section of Gillette Stadium’s upper deck and found 53-year-old Dale Mooney "in apparent need of medical attention." He was rushed to the hospital, where he was later pronounced dead.
The DA’s office said it reviewed videos that showed multiple angles of the scuffle before Mooney’s collapse.
According to officials, Mooney rushed towards Mitchell, and Vieira was trying to split things up.
Legal experts say the dropped charges likely came down to witnesses and video evidence.
"Unfortunately, the person who ended up dying seems to have initiated the confrontation, so they have to look at self-defense as a legitimate defense in case," legal expert Patricia LaFrance said.
The Norfolk District Attorney's Office said it had no comment on the dropped charges.
