Mistrial declared in case against former Dublin corrections officer ‘Dirty Dick’ Smith

(KRON) — The weeks-long trial against former public correctional officer Darrell Smith, who’s accused of sexually abusing five female inmates at the now-shuttered Federal Correctional Institute Dublin in the East Bay, ended in a mistrial Monday after jurors failed to reach a verdict.

wn by prisoners as “Dirty Dick,” faced 15 counts of sexual abuse for crimes that allegedly occurred inside the all-women prison. Smith is part of a sweeping sex abuse scandal involving multiple guards, which led to the permanent closure of the prison in 2024.

The social justice organization California Coalition for Women Prisoners issued a statement following the mistrial.
“Survivors shared extremely disturbing testimony over the course of days, including how Smith raped and digitally penetrated a number of them, masturbated while watching women shower, spanked them, and used coercive tactics such as withholding their mail or not letting them leave their cells if they would not flash their breasts or agree to sexual encounters with him,” the statement from California Coalition for Women Prisoners reads.

A retrial date for the case is tentatively set for Sept. 15, 2025. One of Smith’s accusers, former Federal Correctional Institute Dublin inmate Aimee Chavira, said that she and her fellow former inmates will continue their fight for justice.
“This mistrial is devastating, especially given how difficult and traumatizing it was for survivors to testify,” Chavira said in a statement. “To the families of those still incarcerated: Your loved ones will need your support after receiving this news. No matter what happens, we must remember that the ‘rape club’ at Dublin was made possible by a widespread culture of complicity and cover-ups, and the Bureau of Prisons continues to abuse and neglect people at federal women’s prisons all over the country. We will not rest until this entire system is held accountable.”
