House legislators narrowly pass library obscenity bill

BISMARCK, ND (KXNET) — On Monday, state lawmakers passed a bill that could mean public libraries have to keep inappropriate material away from kids.
In a 49-45 vote, the house passed Senate Bill 2307, which means both public and school libraries must move any obscene content into an area that's
not easily accessible to minors. That could be in a cabinet with a sign or behind a roped-off area where only adults are allowed.
The bill also says that libraries and school districts must report to legislative management next year on how they're complying with the law.
A complaint against content in a library could be sent to a county state's attorney to investigate and give an opinion within two months.

Senator Keith Boehm from Mandan sponsored the bill, arguing that some activists are using legal loopholes to push a sexual agenda.
"Is Lady Chatterley's Lover by D.H. Lawrence, is that considered pornography? It's pretty racy. A lot of stuff going on in there. Is that pornography?" Rep. Eric Murphy from Grand Forks asked. "So, if I want to say that that's pornography, I go to my local library and say I want that removed and I don't like what they've done, I take it to the state's attorney and say they didn't do it right."
"They were a bunch of good old boys and good old girls trying to do the right thing. When you keep hearing that motion's out of order, you really can't get anything done," Rep. Mike Brandenburg from Edgeley said. "And so, Mr. Speaker, members of the assembly, the process doesn't work."
Under the law, if a state's attorney finds a violation, the school district would be notified along with the superintendent of public instruction, and must take corrective action within ten days. Libraries and school districts who don't could be prosecuted.
