BAKERSFIELD, Calif. (KGET) -- A Bakersfield man who was punched by a police officer during his arrest in December has been acquitted of all charges.
A jury on Monday acquitted Victor Manuel Ayala Jr. of resisting arrest and providing false identification to police.
Last week, the court acquit
ted him of spousal battery following a defense motion that cited "a complete lack of evidence," according to the Kern County Public Defender's Office.
The charges were misdemeanors.
"Mr. Ayala complied with all commands once he realized police were present," said Deputy Public Defender Kayla Hughes, Ayala's attorney. "Despite that, he was forcefully taken down and struck without justification."
On Dec. 28, police were called to a home on Columbus Street to a report of a domestic disturbance. They heard a loud argument coming from inside.
Officers knocked and a male voice responded with an expletive. Officers then kicked open the door and encountered Ayala standing in the middle of the living room, according to a Public Defender's Office release.
He allegedly refused to follow orders to turn around, and instead tensed his hands and pulled away when officers tried to grab him, according to the release. An officer punched him in the face and back, the release said.
