Senate narrowly passes bill that could overrule townships and property owners

BISMARCK, ND (KXNET) — By just nine votes, state senators passed one bill on Friday that could change the authority for large energy developments.
Lawmakers passed House Bill 1258, which was sponsored by Edgeley Representative Mike Brandenburg. The bill states that a permit issued for a new ele
ctric transmission project from the Public Service Commission could supersede and preempt the requirements passed by a local county or township if those rules are found to be unnecessarily restrictive.
Rep. Brandenburg brought the bill after county leaders in Stutsman and LaMoure Counties had taken steps opposing a power line project from Jamestown to Ellendale.

"Like I said, I support local control, but sometimes, the local folks go a little too far," Sen. Terry Wanzek (R-Jamestown) said. "And it seems or appears to me that the goal is to stop the project." Sen. Terry Wanzek from Jamestown said.
"We don't want to encourage industry to come in here and step on the throat of our landowners and then come in here and tell us to go on and get involved and intervene," Sen. Jeff Magrum (R-Hazelton) said. "That's not our duty. That's not our place."
Landowners had testified that Otter Tail Power Company and Montana Dakota Utilities had not been honest or transparent with landowners or the Public Service Commission about the Jet-X power line project. That line is expected to cost around $440 million, and will impact around 170 landowners. It is scheduled to be finished in 2028.
