The Department of Justice states that 41-year-old Crystal Gesumaria, between July 2013 to August 2022, stol
e $93,603 in Social Security Administration (SSA) disability benefits by failing to report her 2013 marriage and making multiple deceiving statements to SSA regarding her marital status.
Gesumaria had also been receiving disabled adult child (DAC) benefits since March 2005, which married individuals are ineligible for. The SSA made her aware of this eligibility criterion when she began receiving DAC benefits and sent several written reminders of her obligation to report if there were any changes to her marital status.
During a disability review in 2016, she submitted to SSA forms and an affidavit from her husband with misleading information about their relationship with references to him as a “friend” or “roommate.” When she was confronted about an allegation that she was married in May 2022, she denied knowing anything about the marriage.
Gesumaria was sentenced to three years of probation and ordered to pay $93,603 in restitution. She pleaded guilty to one count of misdemeanor theft of government money. She was charged back in October 2024.
