Mistrial declared in Bakersfield vehicle theft, chase

BAKERSFIELD, Calif. (KGET) -- A mistrial was declared Tuesday after jurors failed to agree on a verdict in the case of a woman who said an armed passenger threatened to kill her and ordered her to flee from police in a stolen pickup.

ading a peace officer, vehicle theft and possession of a stolen vehicle, and a misdemeanor charge of hit and run resulting in property damage, according to a release from the Kern County Public Defender's Office.
Cassie Short faced more than 10 years in prison if convicted, the release said. A retrial is scheduled next month, court records show.
The release gave a summary of the incident leading to her arrest.
On the night of Dec. 7, deputies responded to a report of a stolen pickup near South Owens Street and South Virginia Avenue. They found the truck and Short briefly stopped. Deputies ordered her and a male passenger out of the vehicle.
Short leaned out the driver's side window -- showing her face to deputies -- then hit the gas and sped away. She ran a stop sign and lost control while trying to turn onto Villa Street, hitting a parked minivan.
Short was taken into custody; the passenger got away.
At trial, Deputy Public Defender Kelsey Stout argued Short "acted under the immediate threat of death," according to the release. He presented evidence the passenger held a gun to her and threatened to kill her if she stopped for deputies.
"Cassie wasn't running from the law, she was running from a man with a gun to her ribs," Stout said in the release. "The jury saw the fear and the truth in her story, and we're grateful that the majority recognized she was a victim, not a criminal." ...read more read less
