Man guilty of murder following fatal North Street gas station stabbing

ROCHESTER, N.Y. (WROC) – A man has been found guilty of Murder following a July 2024 fatal stabbing at a gas station on North Street.
On July 26, Rochester Police responded to the gas station on North Street around 9:30 p.m. for the report of a disturbance inside the store and found 38-year-ol
d Christopher Austin who had died from a stab wound in his neck.
Following an altercation between 46-year-old Herbert Montgomery and Austin inside the gas station that led to the stabbing, officers said Montgomery fled the scene in a vehicle. Within twelve hours he was found and arrested.
At the time of the murder, Montgomery was a twice-convicted felony offender and also on federal probation.
During the course of the investigation, it was also learned that 42-year-old Sarah Lee McFadden, who’s in a relationship with Montgomery, tampered with evidence and attempted to hinder prosecution related to the murder of Austin, police say. McFadden was taken into custody at the same time as Montgomery. McFadden was charged with tampering with physical evidence and hindering prosecution.
Both McFadden and Montgomery plead not guilty to the charges.
Montgomery is set to be sentenced on May 7 in Monroe County court. ...read more read less
