The first shooting occurred on Sunday, Feb. 23, at around 1 p.m. on Mountain Road, near Juan Tabo and Lomas boulevards, when officers responded to a 911 domestic dispute call. Officers were made aware that the suspect, 48-year-old Benjamin Raymond, was a felon and was affiliated with an extremist "neo-Nazi" prison gang, the Aryan Brotherhood. Raymond was released from prison in 2021 and was released from probation in 2023.
After interviewing both Raymond and the caller, officers told Raymond he was under arrest. He then fled, and officers wrestled him to the ground. Throughout the struggle, Raymond made multiple statements, such as, "I don't want to do this," "Don't make me do this," and "My finger is on the trigger." Raymond was able to get free enough to grab a gun that was concealed on his person and put his finger on its trigger. A taser was deployed in the altercation, but Raymond pointed his gun in the direction of officers, and the shooting ensued. Raymond received aid but died on the scene as a result of the shooting.
According to APD's investigation, Raymond is thought to have fired at least one round, which struck the asphalt. Nine officer casings and 14 fragments were found at the scene. APD said 766 pounds of marijuana were seized from the property following the shooting. Due to the suspect's gang affiliation, APD did not name the two officers involved in the shooting but did confirm that neither had a past history of officer-involved shootings.

The second shooting took place the morning of Friday, Feb. 28, at an apartment complex on Montgomery Boulevard between Juan Tabo and Tramway boulevards. According to APD, 67-year-old David McElvain's supervisor called 911 after he made a concerning statement regarding his absence from work.
Albuquerque Community Safety responded to the call but did not make contact with McElvain. The ACS responder then requested police assistance. When officers arrived, they knocked at the door and called for McElvain numerous times, reiterating that he was "not in trouble" and that they were there to help.
When the apartment door opened, McElvain had a firearm in hand, and it was pointed in the direction of the officers. At least one of the officers fired, and McElvain was struck and killed. McElvain's gun had a fully loaded magazine but no bullet in the chamber, according to police. The officer involved was Jonathan Barela, who has worked with APD since 2021 and has no prior history of officer-involved shootings. ...read more read less
