CLOVIS, Calif. (KSEE/KGPE) - Clovis Police released store surveillance video on Friday showing an incident the previous weekend at a Target in the city in order to "address the many inaccuracies circulating around social media."
According to the police department, on March 23 at 6:11 p.m., office
rs responded to a report of a disturbance involving a group of juveniles in front of the Target at Clovis Avenue and Shaw Avenue.
Upon arrival, officers say they learned Herculano Tucay, who was walking into the store with his wife and son, became involved in a verbal confrontation with the teenagers. The verbal confrontation then escalated to a physical confrontation.
In a previous update from the Clovis Police Department, officers reported that Tucay sustained extensive injuries after being assaulted by at least two juveniles, even after he was on the ground. Friday's update from the Clovis Police Department states that investigators determined this was not the full story, with surveillance footage from the store showing that Tucay and the juvenile sustained serious injuries.
According to the police department, Tucay held onto the teenager's hair, refusing to let go, despite his son and other people trying to pull him off. Emergency personnel responded and treated several people, who were transported to the hospital in stable condition.
The police department states they know charges were not filed in this case by the Fresno County District Attorney's office, and that they "recognize that the District Attorney must meet a different legal standard for filing charges and pursuing a conviction." They add that they support the DA's decision not to file charges.
In a statement to YourCentralValley.com on Friday evening, the Fresno County DA's office says that "we stand by our decision [not to file charges] and appreciate the Clovis Police Department releasing the surveillance footage and believe the video speaks for itself."
