CLOVIS, Calif. (KSEE/KGPE) - The Fresno County DA's office says no charges will be filed after a man suffered what was described as "extensive injuries" in a fight outside a Target over the weekend.
The DA's office announced on Thursday that their staff considered the incident "a case of mutual c
ombat" and that the evidence did not meet the legal standard needed to support criminal charges.
According to the Clovis Police Department, on Sunday at around 6:10 p.m., they responded to a report of a group of juveniles involved in a disturbance in front of the Target on Clovis and Shaw avenues.
Officers reported that a man, identified as Herculano Tucay, and his wife were walking into the store when they became involved in an argument that got physical with juveniles. Tucay reportedly received "extensive injuries" from at least two juveniles, even after he was on the ground.
Police report four juveniles were arrested on suspicion of multiple charges. The two victims were transported to a local hospital, police say.
On the decision not to file charges, Fresno County District Attorney Lisa Smittcamp says her office is committed to ensuring that all cases are evaluated fairly and based solely on the evidence and the law.
"While our office does not typically issue press releases when declining to file charges, we didso in this case due to the extraordinary public interest," said District Attorney Lisa Smittcamp."We want to assure the community that this decision was made after a meticulous review ofall available evidence and in accordance with the law." ...read more read less
