Bakersfield man gets 12 years, 4 months for pistolwhipping girlfriend

BAKERSFIELD, Calif. (KGET) -- A man was sentenced to prison on Wednesday after repeatedly pistol-whipping his girlfriend, causing her to have a broken jaw.
Kern County Superior Court Judge Charles R. Brehmer said he considered the mitigations and aggravations in the case of Stephen Alan Swain at
the sentencing hearing.
Swain, 40, was sentenced to 12 years and four months in prison. He will need to pay restitution to the victim, according to Brehmer. She will also receive restitution on behalf of the four minor children who witnessed the assault as their guardian.
A Kern County jury found Swain guilty of assault with a semiautomatic weapon, domestic violence and four counts of child abuse on Nov. 8. He was acquitted of shooting at an inhabited dwelling, court records show.
Swain was also charged with threatening in order to terrorize, but the count resulted in a hung jury, according to court records. Brehmer dismissed this count at the sentencing.
On April 27, 2023, deputies responded to a Bakersfield home and found Swain’s injured girlfriend. She was bloody and suffered a broken jaw, according to the Kern County District Attorney’s Office.
According to the victim, she and Swain were arguing when Swain pinned her face to the couch, restricting her breathing. He then began pistol-whipping his girlfriend over 20 times in the face using a semiautomatic handgun, the DA’s Office said.
The victim followed Swain outside as he fled with his four minor children, who witnessed the incident, according to the DA’s Office.
