ROCHESTER, N.Y. (WROC) — Tony Brown, 42, pleaded not guilty to murder in the second Tuesday morning.
Seated behind him in Rochester City Court was a group of about 10 of Brown’s family and friends.
Across the courtroom sat roughly 50 loved ones of Ali Saleh, 30, who police say Brown shot a
nd killed Sunday evening.
Brown was arrested hours later not far from the store with investigators saying they found a handgun and other evidence.
Khaled Shaibi, an uncle of Saleh’s wife, told News 8 the group remains in shock.
“It’s a big loss for the family, his family and the community as well,” Shaibi said.
Saleh had taken over Sana’a Food Market at the corner of Clifford Ave and Miller Street from his father, Shaibi said, and was sitting behind the counter when Brown entered and shot him four times.
“Just killing (him like he was a) little animal,” Shaibi said. “Even with an animal, you can have a little mercy on an animal. This is taking somebody’s life, you terminated somebody’s life. And all these people love him.”
Shaibi agreed with police that the shooting appeared to be retaliation for a fight inside the store days prior – a fight that Shaibi said did not even involve Salah.
According to family, Saleh had a 3-year-old daughter, who he and his wife gave birth to after eight years of trying.
“My niece was just shocked when they told her what happened to him,” Shaibi said. “And he was the only son to his father.”
Saleh’s father ran the store for decades before moving to South Yemen, where Saleh was born.
Brown, meanwhile, did not have a criminal history, according to the Monroe County District Attorney’s Office.
A preliminary hearing was scheduled for March 28, but the case will likely head to a grand jury before then. ...read more read less
