Marion County judge blocks release of Indiana abortion records
INDIANAPOLIS (WISH) — A Marion County judge on Monday extended a preliminary injunction to prevent the Indiana State Health Commissioner and Voices For Life Inc. from disclosing Terminated Pregnancy Reports under the Indiana Access
to Public Records Act.
The reports include information about the procedure itself but also patient data, including their medical history and demographics.
Judge James Joven of Marion Superior Court 13 had issued a preliminary injunction Feb. 13 that was set to expire Monday.
Two OB-GYNs who perform the reproductive health care procedure, Dr. Caitlin Bernard and Dr. Caroline Rouse, on Feb. 7 filed a lawsuit to stop the release of the reports with confidential medical information, which is protected under the Indiana Access to Public Records Act.
Bernard says that the release of the reports could lead to patients losing trust in their physicians’ ability to protect private health information.
The doctors’ lawsuit came after the Indiana Department of Health in February settled with Voices for Life, an anti-abortion group, and agreed to make the records public Voice for Life after halting the practice in 2024. Bernard and Rouse had initiated a lawsuit against the Indiana Department of Health in June 2024 to prevent the reports from going to Voices for Life.
Bernard was disciplined in 2023 for sharing with a reporter that a 10-year old girl who’d been raped traveled to Indiana from Ohio to get an abortion.
