ALBUQUERQUE, N.M. (KRQE) – A 16-year-old accused of being in a stolen car with two others and intentionally hitting a man on a bicycle will remain in custody. Police say that last year, William Garcia was in a stolen car with 11-year-old Messiah Hayes and 13-year-old Johnathan Overbay when Overba
y intentionally hit Scott Habermehl, who was biking to work. Habermehl later died from his injuries.

Loved ones of Habermehl prepared a statement for the hearing which was read by the Bernalillo County District Attorney's Office. "The absolute callousness with which they considered taking a life should argue strongly that this is not someone who deserves any kind of right to interact with civil society at all under any circumstances. The harm he and his cohorts have allegedly done already, and the further risk his freedom represents to that society is intolerable," said Prosecutor Bridge McKenney who read the statement.
Prosecutors are looking to charge Garcia as an adult. If convicted as an adult, he faces life in prison. ...read more read less
