Canutillo ISD Board of Trustees president served with lawsuit for removal

EL PASO, Texas (KTSM) — Canutillo Independent School District's Board of Trustees President Armando Rodriguez was served with a lawsuit last Friday, March 14, on his removal from the board, according to the citation.
The citation says Rodriguez has 20 days from when the lawsuit was filed to res
pond with a written answer.
As we previously reported, a group of local citizens filed a petition to have Rodriguez removed from the board in May 2024, due to his previous arrest records of driving while intoxicated since his election into the board in 2005.

The petition also stated that Rodriguez allegedly had his attorney try to expunge and clear his record so that the court records would be hard to find.
The petition also gave a timeline of Rodriguez’s arrest, stating that his first arrest was in September 2013 and his second arrest was in December 2021.
The petition stated that after Rodriguez’s second arrest, he was required to have DWI supervision and a camera ignition interlock device installed in any vehicle that he was currently driving, according to court records.

Regarding Rodriguez's first arrest on Sept. 26, 2013, an officer arrived at the scene of a vehicle that had crashed into a telephone pole at the 6800 block of Strahan Road, according to court documents.
Rodriguez was standing about 10 feet from the vehicle and had blood on his nose, according to court documents.

Rodriguez told the officer that he had fallen asleep while driving home. He also told the officer that he was coming from "Network" which is a restaurant bar, according to court documents.
The officer noticed Rodriguez's speech was slurred and also detected an odor of alcohol that was coming from Rodriguez's breath.

Rodriguez admitted to the officer he had a glass of wine and a sobriety test was administered. Rodriguez had a BAC of .146 and .141, according to court documents.
According to court documents, Rodriguez completed a pre-trial diversion program after his arrest in 2013.

Regarding Rodriguez's second arrest in Dec. 12, 2021, officers were dispatched to the intersection of Doniphan Drive and Canutillo/La Union in reference to a welfare check.
Officers arrived to find a vehicle parked on the turning lane of the 7000 block of Doniphan Dr. facing northbound.
Rodriguez was found in the driver's seat of the vehicle, and told officers that he was coming from a friend's house and was heading home.
Officers noticed Rodriguez was slurring his speech, and his breath also smelled like alcohol, according to court documents.
Rodriguez was asked if he had been drinking to which he said no. He then performed a standardized field sobriety test which resulted in officers determining that Rodriguez was impaired, according to court documents.
Rodriguez refused to perform a breathalyzer test or give a sample of his blood, according to court documents.
Rodriguez shared a statement to KTSM after the petition was filed in 2024, which reads the following:
“The petition is a frivolous and meritless attempt by a sitting board member to attack my pro-public education stances. Ms. Breanne Barnes has asked her colleagues to file this ridiculous attempt at circumventing the people’s vote so that she can continue to push school vouchers, faith-based education and other anti-public education initiatives.
The group that filed the petition failed in their attempt to defeat the bond election and they are now resorting to theatrics to intimidate the district and reverse the will of the voters. It’s my hope that an impartial judge will respect the electors that selected me to serve.
I have been upfront about my legal issues and have worked to address them. I have not been convicted of any crime that merits my removal and I intend to continue to serve the children and taxpayers of Canutillo.”
According to CISD's website, Rodriguez is currently listed as board president, vice president, and secretary for the district's school board. ...read more read less
