KSDE issues statement after immigration directive

TOPEKA (KSNT) - The Kansas State Department of Education says it won't share any student data without a warrant, subpoena or lawful order.
The statement comes after a directive by the U.S. Department of Homeland Security to rescind guidelines that limited law enforcement's ability near sensitive areas such as schools and churches. The change will allow Immigration and Customs Enforcement and Customs and Border Protection agents near schools, hospitals and places of worship.
“This action empowers the brave men and women in CBP and ICE to enforce our immigration laws and catch criminal aliens—including murders and rapists—who have illegally come into our country," the Department of Homeland Security said in a press release. "Criminals will no longer be able to hide in America’s schools and churches to avoid arrest. The Trump Administration will not tie the hands of our brave law enforcement, and instead trusts them to use common sense."
Schools are advised to continue to follow the law and abide by their board-approved policies regarding investigations and/or arrests on school grounds. KSDE wishes to assure school personnel, parents, and the students of Kansas that we will not share any student data without a warrant, subpoena, or other lawfully issued court order.

The KSDE recommends schools make sure family emergency contact info is up to date, that staff follow board-approved policies regarding investigations and recommended schools issue a reminder that no student information will be shared without consent, a warrant, subpoena or court order.

Tuesday’s action did not change the law, nor did it increase the U.S. Department of Homeland Security’s authority. To that end, we remind school personnel that their ultimate responsibility is the education and protection of all students.
