State lawmakers mull bill to give more protection to student victims of sexual assault

BISMARCK, ND (KXNET) — Right now, state lawmakers say they want more protection for students who are victims of sexual assault.
Representative Daniel Johnston is proposing House Bill 1247, which if passed, would require schools to separate sexual assault victims from the student who is convicted of the crime.Under Johnston's proposal, the school could expel the offender, transfer him or her to another school or offer virtual learning to that student.
One mother testified in support of the bill, recalling how her daughter was groomed and sexually assaulted by a classmate.
"Where else is a victim expected to possibly face their attacker on a daily basis, and why of all places should it be a school where children are spending a majority of their day?" Alexis Dion said. "Victims have already experienced the unimaginable and should not be expected to face re-traumatization."

"The school districts already have the legal requirement to provide free open and accessible public education to all the students, and this really speaks more to school districts that might only have, many of our school districts only have one building, K through 12," KrisAnn Norby-Jahner with the North Dakota School Boards Association said.
Norby-Jahner said under state law, school districts can't force a family to open enroll a student in another school.
Norby-Jahner suggested amending the bill to require a student offender to follow a safety plan by the school, including no contact with the victim.
